How Can a Third Party with an Interest Protect Their Rights in a Dispute Submitted to an Arbitral Council or a Customary Court under Ethiopian Arbitration & Conciliation and Customary Dispute Resolution Legal Frameworks ? =================================================== A brief personal commentary examining Proclamation No. 1237/2021 (Arbitration and Conciliation Proclamation) Articles 6, 40, 48(1), and 48(5) in conjunction with Oromia Customary Courts Proclamation No. 240/2021 Articles 25, 33(1, 2, 11), and Oromia Customary Courts Regulation No. 10/2022 Article 40(5–7). =================================================== There are various mechanisms through which people resolve disputes or access justice. Among these, one mechanism is the Arbitration and Conciliation system established under Proclamation No. 1237/2021, which operates based on the consent and agreement of the parties. Another is the Oromia Regional State Customary Courts system, established by Proclamation No. 240/2021 and subsequently expanded to other regions. Both serve as Alternative Dispute Resolution (ADR) mechanisms; however, while the former possesses an international character, the latter is rooted in ancient indigenous traditions. Because the jurisdictional power of both institutions (arbitration tribunals and customary courts) relies on the agreement of the individuals involved, their establishment is strictly anchored in party autonomy, as explicitly stipulated under Article 6 of Proclamation No. 1237/2021 and Article 25 of Proclamation No. 240/2021. When comparing both proclamations side by side, it is evident that much of the latter draws from the former, though Proclamation No. 1237/2021 is broader in scope and objectives than the Customary Courts Proclamation. Overall, both proclamations share significant similarities in establishing a broad legal framework designed to make access to justice available to the public. However, a critical issue that requires careful analysis is how a third party—who is outside the voluntary agreement that brought the case to arbitration or customary court, but who holds a legal right or interest in the subject matter—can protect their rights or access justice. This point presents a challenging practical issue because it is not explicitly addressed in Proclamation No. 240/2021. When a third party claims "my rights are affected" or "I have an interest" in a dispute voluntarily brought by litigants to arbitration or customary court; should they directly submit an intervention application to the arbitration tribunal or customary court, similar to the regular Civil Procedure Code process or should they await the rendering of the decision and then lodge a grievance with the regular court of competent jurisdiction or should they directly institute a fresh lawsuit in a regular court of competent jurisdiction regarding the right they claim or is there another legal remedy available for them? While these questions are answered to a certain extent under Proclamation No. 1237/2021, they remain unclear under Proclamation No. 240/2021. In connection with these questions, Article 40(1) of Proclamation No. 1237/2021 explicitly provides that a third party who is not part of the arbitration agreement, but claims an interest in the pending dispute or asserts that "the decision rendered by the tribunal will affect my rights," can submit an intervention application to the tribunal before a decision is rendered. This incorporates the intervention procedures outlined under Articles 41 and 42 of the Civil Procedure Code. Furthermore, Article 40(2) of the Proclamation provides that if one of the original parties to the arbitration agreement claims that a third party bears liability or ought to indemnify them, they can request the third party to be joined in the proceedings (3rd party defendant), allowing the defendant to include the third party in the arbitral dispute. This reflects the provisions of Article 43 of the Civil Procedure Code.

🇪🇹 Семь группировок против одного премьер-министра
Вооружённые и оппозиционные организации Эфиопии объявили о формировании «Коалиции за выживание эфиопских народных сил» (Tsemdo). Цель — свержение правительства премьер-министра Абия Ахмеда и формирование инклюзивной переходной администрации. Заявление зачитал в эфире телеканала Tigrai TV председатель «Национального движения Амхара Фано» Земене Кассие.
В объединение вошли «Национальное движение Амхара Фано» (AFNM), «Народный фронт освобождения Тыграя» (TPLF), «Армия освобождения Оромо» (OLA), «Фронт национального освобождения Огадена» (ONLF), афарский «Революционно-демократический фронт единства» (Ugugumo), «Народно-освободительное движение Бенишангуль» (BPLM) и «Народно-демократическое движение Гумуз» (GPDM). Таким образом, коалиция представлена в шести из 12 штатов страны.
В документе правительство названо «диктаторским режимом, основанным на личной власти и совершающим геноцид». Федеральные органы пока публично не ответили. Но ещё в июле Абий Ахмед, выступая в парламенте, называл подобные союзы «нечестивыми» и признаком отчаяния.
Эфиопский академик Эйоб Тилаун объяснил сближение общей угрозой со стороны центра.
«Союзные силы исходят из того, что правительство угрожает существованию каждой из них», — сказал он.
Норвежский специалист по Африканскому Рогу Кьетил Тронволл оценил шансы повстанцев в случае вооружённого противостояния с федеральной армией.
«Я не уверен, что они смогут выдержать такую войну», — заявил он, указав на преимущество властей, в том числе в беспилотниках.
По его словам, ситуация изменится, «если у группировок будет единое военное командование». В этом случае правительству пришлось бы иметь дело с «потенциальными четырьмя-пятью фронтами».
Эксперты также указывают на неурегулированные конфликты и противоречия внутри коалиции. К примеру, в войне 2020–2022 годов Фано сражалось на стороне федеральных сил против НФОТ, спор за Западный Тыграй между амхара и тыграйцами не снят.
Поэтому нынешний союз хрупок. Его скрепляет общий противник, а не общая программа, и без единого командования он может рассыпаться, едва центр перестанет быть главной угрозой.
